Waiting for Tivo to buffer Heroes…

I have only the most basic understanding of economics, but I’m a registered legal expert in brutal stump-fuckings at both the state and federal level. And Mr. 19%’s bailout proposal has “ankle grabber” written all over it. Of concern, Section 8:

Decisions by the Secretary pursuant to the authority of this Act are non-reviewable and committed to agency discretion, and may not be reviewed by any court of law or any administrative agency.

One final hurrah for the Unitary Executive theory. Stop this “democratic republic,” I wanna get off.

  1. Non-delegation: Paulson wants to spend the worlds largest pile of taxpayer money to socialize private debt arising from his colleague’s mismanagement.

    Separation of Powers: Paulson wants to do this as an unelected, unaccountable political appointee, absent checks and balances or judicial review.

    Conflict of Interest: Henry Paulson is a former CEO of a huge investment bank and securities management firm, Goldman Sachs, which will certainly benefit from his largesse.

    What could possibly go wrong?

    And even if this was challenged, and not thrown out for want of “standing” (which it probably would be), I genuinely believe that the current Supreme Court would look at it and see no real problem.

    It occurred to me the other day that the end of the Roman republic was due to a lot of things, but particularly an ultra-conservative “reformer” (Sulla) who undid a lot of the policies that benefitted the middle class, followed in short order by a maverick pseudo-populist war-hero (Caesar).

    Just sayin.
